VanSite Advent Calendar Competition

1.1 These terms of participation govern the conditions for taking part in the "VanSite Advent Calendar" competition and the processing of data collected from participants.

1.2 The organizer of the competition is VanSite UG (haftungsbeschrankt), Am Sudhang 8, 33739 Bielefeld, email: team@vansite.eu.

1.3 By participating in the competition, participants accept these terms of participation.

1.4 The competition has no connection to Instagram or Facebook and is neither sponsored, supported nor organized by Instagram or Facebook.

2.1 Eligible to participate are natural persons aged 18 or over with a place of residence in Germany.

2.2 Excluded are employees of VanSite UG, their family members, and employees of cooperation partners who are involved in creating or running the competition.

3.1 Participation in the competition is free of charge and only possible online via VanSite's Instagram and Facebook pages.

3.2 To enter the competition, participants must carry out the actions specified in the respective competition post. These may include, for example:

• Answering the question posed in the comment section of the post.

• Tagging friends in the comment section.

3.3 The terms of participation vary per competition day and are stated in the respective competition post. Actions not mentioned in the post do not constitute valid participation.

3.4 Each participant may only participate once per competition day. Participating with multiple profiles is not permitted.

3.5 Participants may enter on all advent calendar competition days. However, once a participant has won a prize during the competition period (01.12.2024 to 24.12.2024), that participant is excluded from all further competitions and prizes.

4.1 The competition takes place from 01.12.2024 to 24.12.2024.

4.2 Every day at 5:00 PM, a new prize will be presented on VanSite's social media accounts.

4.3 Participation for the respective prize is possible until 11:59 PM on the same day

5.1 The winners are drawn at random from all valid entries on the following day.

5.2 The winners of the respective competition day are announced by 9:00 PM on the following day via VanSite's Instagram and Facebook stories, with winners named by their stated profile name on the social media channels.

6.1 Winners must contact VanSite by private message (PM) within 7 daysof the announcement and naming, and provide their delivery address.

6.2 If a winner does not make contact within this period, the prize is forfeited without replacement.

6.3 The prizes are sent either by VanSite or directly by the respective cooperation partner to the specified address. VanSite or the cooperation partner accepts no liability for loss or damage to the prize during shipping. Resending is excluded.

6.4 Cash payment or exchange of the prize is not possible.

6.5 Any taxes arising in connection with the prize must be borne by the winner.

7.1 Participants agree that their submitted comments or contributions in connection with the competition may be published and used by VanSite free of charge on social media and the website.

7.2 Participants warrant that publication will not infringe any third-party rights and indemnify VanSite against all third-party claims in this regard.

7.3 If submitting a photo is required for participation in the competition, the participant confirms by submitting it that they own all rights to the photo or are authorized to submit it. They also warrant that the photo is free of third-party rights and does not infringe the personal rights of any persons depicted.

The participant grants VanSite as organizer the exclusive right to use the photo, whether edited or unedited, with or without attribution, in connection with the campaign and for advertising purposes in all media, and transfers all rights of use to VanSite. This grant of rights is unlimited in time and territory, is made without remuneration, and includes the right to transfer to third parties acting on behalf of or affiliated with the organizer.

8.1 VanSite reserves the right to cancel or end the competition at any time without prior notice and without giving reasons.

8.2 VanSite is entitled to exclude participants from the competition who violate the terms of participation, provide incorrect personal details, or attempt to manipulate the competition.

8.3 Participants who enter multiple times with different accounts or otherwise circumvent the terms of participation will be excluded from the competition.

8.4 The organiser is entitled to change the terms of participation, extend or shorten the time frame, or adjust the prize content, provided there are valid reasons and the changes are reasonable. VanSite will inform participants about any new conditions.

9.1 VanSite is not liable for technical disruptions that occur during data transmission.

9.2 VanSite accepts no liability for lost, damaged, or delayed submissions caused by network, hardware, or software issues.

9.3 The organiser's liability is excluded to the extent permitted by law.

Indemnification clause

Participants' contributions (including images, links, and texts) must not contain insults, false statements, or violations of competition, trademark, or copyright law. If third parties nevertheless assert claims based on a legal infringement, the participant indemnifies VanSite against all such claims. By entering the competition, each participant accepts personal responsibility for any legal violations they may commit.

10.2 The personal data provided by participants is used solely for the purpose of conducting and processing the competition.

10.3 In the event of a win, the winner's data (name, address) will be passed on to the respective cooperation partner for the purpose of delivering the prize.

10.4 If a cooperation partner is located outside the EU/EEA, it may be necessary to transfer data there. In such cases, it will be ensured that the data transfer meets the requirements of the GDPR.

10.5 The legal basis for data processing is Art. 6 para. 1 lit. b GDPR.

10.6 The data will be deleted after the competition has ended and the prizes have been delivered, unless statutory retention obligations apply.

10.7 Participants have the statutory rights to access, rectification, erasure, restriction of processing, data portability, and objection. These can be exercised using the contact details provided above.

11.1 Legal recourse is excluded.

11.4 Should individual provisions of these terms of participation be or become invalid, the validity of the remaining provisions is not affected.

11.5 In the event of disputes relating to this competition, the parties will first seek an amicable resolution.

12.1 This competition has no connection to Instagram or Facebook and is neither sponsored, endorsed, nor organised by Instagram or Facebook.

12.2 The recipient of the information provided by participants is not Instagram or Facebook, but VanSite UG.
