General Terms and Conditions (GTC) for the rental of holiday apartments and caravans as well as pitches by Lisa and Guido Kustner, hereinafter referred to as "landlord". The following regulations are generally deemed to be agreed upon upon conclusion of the contract for the holiday apartment, caravan or pitch named in the booking confirmation. 1. Conclusion of contract (rental agreement) With the binding booking of a holiday apartment, caravan or pitch through the landlord, which can be made online, but also in writing or by telephone, a corresponding contract is concluded which becomes effective when all required information is provided and written confirmation of the booking has been received from the landlord. The contractual relationship is deemed to be terminated if - as stated in section 2.1 - the payment deadlines are not met. In this case, the cancellation fees listed under section 10 apply. Rentals to minors are only permitted with the written consent of a parent or guardian. 2. Payment of the contract price The contracting parties expressly rule out payment of the rental/usage price by crossed check. 2.1. Payment deadlines The payment terms of the booking confirmation apply. 3. Moving into the rental property (arrival) The rental agreement begins on the day of arrival with the collection of the key, from 11:30 a.m. at the earliest, and ends on the last day, unless otherwise agreed, by 10:00 a.m. at the latest and/or when the key has been deposited in the safe. 4. Keys The key codes for the rental property must be handed over to the tenant(s) on the day of arrival upon presentation of the booking confirmation. Lost keys must be reported immediately. The costs for the necessary replacement of the locking system are to be borne by the tenant. 5. Departure On the day of departure, the holiday apartment, caravan, or pitch must be returned to the landlord or a person authorized by the landlord by 10:00 a.m., unless otherwise agreed, in a proper and clean condition (final cleaning excluded), in accordance with the agreed terms and the house rules. Doors and windows must be closed. All keys must be deposited in the safe. The landlord or their representative reserves the right to conduct a detailed inspection and, if necessary, carry out an inspection. Any defects and incompleteness must be recorded in writing and confirmed by the tenant with a signature. 6. Persons The rental property will only be made available to the contractually agreed persons according to the booking. Subsequent changes require the written permission of the landlord. In the event of violations, the landlord is entitled to expel persons not listed in the booking from the holiday property. Furthermore, violations may give rise to claims for damages. 7. Pets, Smoking Pets are permitted with prior agreement. No one is allowed on the beds or sofas outside the front door. It is prohibited to use the garden for small or large business. In the event of violations, a cleaning fee of €100 will be charged. This also applies to visitors of the tenants. Smoking, including e-cigarettes, is generally not permitted inside the holiday apartment, caravan or pitch, as well as inside the buildings and in the garden.8. Maintenance of the holiday apartment, caravan, or pitch: The tenant(s) undertake(s) to treat the rented premises and inventory with care and to protect them from any damage. The tenant is responsible for any damage to the holiday apartment or the property or for any missing inventory that occurs during the rental period, unless the tenant can prove that the damage or missing inventory was not caused by the tenant or the persons accompanying the tenant. The tenant must immediately notify the landlord of any incomplete inventory or existing or newly discovered defects in the rental property; otherwise, the landlord is entitled to compensation claims based on these. 9. Landlord's Obligations: Upon effective conclusion of the contract, the landlord is obligated to provide and hand over the rental property in accordance with the contract. Should the holiday apartment, caravan, or pitch not be able to be used by the tenant as agreed despite the landlord's due diligence or due to circumstances beyond the landlord's control (such as severe weather, fire, explosion, damage to the property, vandalism, etc.), the landlord's liability shall be limited to the agreed and paid rental price. The landlord is not liable for damages beyond his control, in particular construction work (including roadworks) in the neighborhood. 10. Cancellation of the Contract In the event of cancellation, the tenant must reimburse the landlord for expenses after the booking has been confirmed. 11. Rules of Use The house rules for the respective holiday apartment, caravan, or pitch and the property displayed in the holiday apartment, caravan, or pitch are an integral part of the general terms and conditions. For the use of DSL internet access via LAN and WLAN, the "WLAN Rules of Use" must also be observed. 12. Place of Jurisdiction The District Court in Hof has jurisdiction for any disputes arising from this contractual relationship.
